Welcome to the DanceMakers Inc. web app. By accessing or using our web app, you agree to be bound by these Terms of Use. Please read them carefully. If you do not agree, you may not use our services.

1. Acceptance of Terms

By using our web app, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

2. Eligibility

Our services are intended for individuals who are at least 18 years old or minors with parental consent to participate in our dance competitions and conventions. By using our web app, you represent and warrant that you meet these eligibility requirements.

3. Registration and Account Security

  • Account Creation: To use certain features of our web app, you must create an account. You agree to provide accurate, current, and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account. DanceMakers Inc. is not liable for any loss or damage arising from your failure to protect your account information.

4. User Conduct

  • Permitted Use: You may use our web app for lawful purposes and in accordance with these Terms of Use.
  • Prohibited Use: You agree not to use our web app:
    • In any way that violates any applicable federal, state, local, or international law or regulation.
    • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
    • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
    • To impersonate or attempt to impersonate DanceMakers Inc., a DanceMakers Inc. employee, another user, or any other person or entity.
    • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the web app, or which, as determined by us, may harm DanceMakers Inc. or users of the web app or expose them to liability.

5. Fees and Refunds

  • Payment: By registering for our events, you agree to pay the applicable fees. All payments must be received before the attending event’s cutoff date. Competition routines will be removed if payment is not received by this date. If registration is received after the cutoff date, there will be a $20 late fee applied to each attendee.
  • Refunds: There are no refunds. Studio credits are available at the discretion of DanceMakers Inc.

6. Intellectual Property Rights

  • Ownership: The web app and its entire contents, features, and functionality are owned by DanceMakers Inc., its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • License: You are granted a limited, non-exclusive, non-transferable, revocable license to use the web app for personal, non-commercial use, subject to these Terms of Use.

7. Limitation of Liability

To the fullest extent permitted by law, DanceMakers Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the web app.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our web app by any third party.
  • Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the web app.

8. Changes to the Terms of Use

We may update these Terms of Use from time to time. We will notify you of any changes by posting the new Terms of Use on our web app and updating the effective date. Your continued use of our services after any changes constitutes your acceptance of the new Terms of Use.

These Terms of Use are governed by and construed in accordance with the laws of the jurisdiction in which DanceMakers Inc. is based, without regard to its conflict of law principles.
